Synthetic E-Cigarette Ban
If you're involved in the vaping world, you've probably heard about the rise of synthetic nicotine, also known as non-tobacco nicotine (NTN). Created in a lab instead of being extracted from tobacco leaves, NTN is popular due to its purity and smoother taste. However, the FDA is now targeting synthetic nicotine, claiming that vape brands use it to exploit a legal loophole and that it's being marketed to underage users.
In 2009, the Prevent All Cigarette Trafficking (PACT) Act was passed, prohibiting the USPS from delivering cigarettes and smokeless tobacco directly to consumers. In 2020, the Preventing Online Sales of E-Cigarettes to Children Act added Electronic Nicotine Delivery Systems (ENDS), including e-cigs and vapes, to the banned items list.
Until recently, synthetic nicotine wasn't included in this ban. But as of April 14th, 2022, synthetic nicotine products fall under the PACT Act. The FDA now requires all synthetic nicotine manufacturers to submit their products for review within 30 days.
If denied approval, products were removed from circulation around May 15th 2022, and marketing of denied products has been banned. This was a significant blow to the vaping industry and consumers.
