NTN has proven popular with vapers due to its increased purity and smoother taste. However, NTN has recently come under fire from the FDA who views its use in e-cigs as vape brands exploiting a legal loophole to continue to sell their products. The FDA also views synthetic nicotine as being marketed to underage users and is going after the manufacturers for this reason. 

 

For some context, in 2009, the Prevent All Cigarette Trafficking Act (PACT, for short) was passed. This bill prohibits the USPS from delivering cigarettes and smokeless tobacco products directly to consumers. Then in 2020, the Preventing Online Sales of E-Cigarettes to Children Act was passed. This amendment added Electronic Nicotine Delivery Systems (ENDS) to the banned items list. E-cigs and vapes are considered ENDS and thus were removed from shipping circulation. 

 

Until now, synthetic nicotine was not included in this ban. However, as of April 14th, 2022, synthetic nicotine products are now with the scope of the PACT Act. This means the Food and Drug Administration is aiming to crack down on NTN products across the industry. The FDA is requiring all manufacturers of synthetic nicotine to submit their products for review within 30 days of 4/14/22. If their products are denied approval (highly likely), they will be removed from circulation around May 15th. Marketing of denied products will also accordingly be banned. This represents a significant blow to the vaping industry and consumers. Only time will tell how this plays out and if any synthetic nicotine products are approved for shipping and circulation.
